But that does not mean every offensive comment can automatically be grounds for dismissal. The context, the seriousness of the conduct, and the rules the company established beforehand are important.

For example, if an employee posts or expresses a serious insult directed at a coworker or supervisor, the company may take disciplinary action when that conduct violates applicable internal policies. This is especially important when the company has workplace rules or a code of conduct that clearly establishes which behaviors are not allowed and that was communicated to the employee before the incident occurred.

In Puerto Rico, Act No. 80 recognizes as just cause, among other circumstances, a pattern of improper or disorderly conduct and repeated violations of reasonable rules and regulations established for the operation of the company, provided a written copy of those rules was given to the employee in a timely manner. Therefore, having clear policies and providing them to employees is an important part of disciplinary management.

However, it is not simply a matter of the company finding a comment unpleasant and deciding to fire the person. If the employer intends to base the action on a violation of workplace rules, it must be able to show what rule applied, that it was reasonable, that the employee knew about it, and that the conduct actually falls within the prohibition. The employee’s signature may be an important way to show that they received and knew then rules, although the signature alone does not make every dismissal valid.

Care is also needed when the expression relates to employment conditions. Federal law protects certain concerted activities by employees, including when they take place on social media. For example, employees may be protected when they organize or talk with coworkers about wages, benefits, or other working conditions. That protection does not mean every insult is automatically protected: among other circumstances, the conduct may lose protection when it includes seriously offensive behavior.

In other words, if someone simply expresses a protected workplace complaint, that situation should not be confused with an insult or conduct that legitimately violates the company’s rules for civility and behavior. Before firing someone, it is important to review what was said, whom it was directed at, the context in which it occurred, what policies were in effect, and what legal protections might apply.

That is why having clear workplace rules and a code of conduct can make a significant difference for companies. The rules should clearly explain which conduct is unacceptable— such as threats, harassment, discrimination, bullying, or seriously offensive expressions directed at other employees—and should be communicated to the people who work for the company. It is also advisable to apply those rules consistently and assess each case according to its circumstances.

In summary, an insult directed at a coworker or a boss can have workplace consequences and may even help justify a dismissal, depending on the conduct and circumstances. When the company has workplace rules or a code of conduct that was communicated in advance and prohibits that type of behavior, it has a clearer basis for taking action. The key is not simply that someone said something offensive, but that an applicable rule exists, the employee knew what behavior was expected, and the action taken is consistent with applicable labor law.

Social media and workplaces are part of our daily lives, and sometimes an employee’s expression can cross a line and become a workplace matter.
